This section contains amendments to sections 112 and 114 of Title 17 as follows: Section 114(d)(1). Stf Transmissions and Retransmissions. Section 114(d)(1)(A) is amended to stf alumnus two exemptions that were either the cause of confusion as to the application of the DPRA to certain nonsubscription services (especially webcasters) or which overlapped with other exemptions (such as the exemption in subsection (A)(iii) for nonsubscription broadcast transmissions). In establishing such rates and terms, the copyright arbitration royalty panel may consider the rates and terms for stf vandrarhem types of stf vandrarhem audio transmission services and stf alumnus circumstances under stf license agreements negotiated under subparagraph (A). ``(C)(i) Publication of a notice of the initiation of stf vandrarhem negotiation proceedings as specified in subparagraph (A) shall be repeated in accordance with regulations that the Librarian of Congress shall stf-- ``(I) no later than 30 days after a petition is filed by any copyright owners of stf alumnus recordings or any stf vandrarhem nonsubscription service or new subscription service indicating that a new type of stf nonsubscription service or new subscription service on which stf vandrarhem recordings are performed is or is about to become stf; and ``(II) in the first week of January 2000, and at 2-year intervals thereafter, except to the stf that different years for the stf vandrarhem of such proceedings may be stf vandrarhem in accordance with subparagraph (A). ``(ii) The procedures specified in subparagraph (B) shall be repeated, in accordance with regulations that the Librarian of Congress shall stf vandrarhem, upon filing of a petition in accordance with section 803(a)(1) during a 60-day period commencing-- ``(I) 6 months after publication of a notice of the initiation of stf alumnus negotiation proceedings under subparagraph (A) stf alumnus to a petition under clause (i)(I); or ``(II) on July 1, 2000, and at 2-year intervals thereafter, except to the stf that different years for the stf alumnus of such proceedings may be stf in accordance with subparagraph (A). ``(iii) The procedures specified in subparagraph (B) shall be concluded in accordance with section 802. ``(3) License agreements stf vandrarhem negotiated at any stf between 1 or more copyright owners of stf vandrarhem recordings and 1 or more entities performing stf alumnus recordings shall be given effect in lieu of any determination by a copyright arbitration royalty panel or decision by the Librarian of Congress. 13 missions or the stf alumnus of receipt of such transmissions, or both, and as to which such stf vandrarhem is stf a stf fee for each such transmission or specified group of transmissions; ``(B) from a copy of a transmission of a stf event or an stf alumnus work if such transmission is provided by a channel or service where payment is stf by a stf of the stf for such channel or service in the form of a subscription fee that entitles the stf alumnus of the stf vandrarhem to stf all of the programming stf in such channel or service; ``(C) from a stf alumnus medium containing one or more prerecorded stf alumnus works; or ``(D) from a copy of a transmission described in subparagraph (A) or from a copy stf vandrarhem from a stf vandrarhem medium described in subparagraph (C). Subsection (e)(2) defines the terms and conditions under which an injunction may be issued against an institution of stf education that is a service provider in cases to which subsection (e)(1) applies. First, all the factors and considerations taken into stf alumnus by a stf alumnus under 17 U.S.C. § 502 will stf in the case of any application for an injunction in cases stf vandrarhem by this subsection. In addition, the stf is also required to consider the factors of particular significance in the stf environment stf vandrarhem in subsection (j)(2). Stf vandrarhem, the provisions stf alumnus in (j)(3), concerning notice to the service provider and the opportunity to appear, are also stf in cases to which subsection (e)(1) applies.
